Express Assumption of Risk and Indemnity Agreement

Escape With Us Now Limited (hereinafter called the “Company”) endeavors to undertake reasonable steps and measures to guarantee your safety and that of your property during the outdoor adventure. Such include but are not limited to adequate briefing on the program, safety and travel itinerary, the provision of knowledgeable guidelines and support staff. Please read and be certain you understand the implications of signing this assumption of risk and indemnity agreement form. Proceeding to participate in the activity, with or without signing, deems you have agreed and expressly consented to be bound by the policy provisions herein.

Having signed up for participation in the outdoor adventure organized by the Company, I affirm and acknowledge the following;

1. That I have been adequately informed of the inherent risks and hazards associated with the above-mentioned outdoor adventure, transportation of equipment related to the activity and traveling to and from the activity sites.
2. That I have been given a chance to ask questions concerning the adventure and all such questions have been answered to my satisfaction.
3. That these risks and hazards may be foreseen or reasonably unforeseen before and/or during the adventure.
4. That these risks and hazards include but are not limited to;
   • Physical, physiological and/or psychological injury and/or ailment from the activity and equipment utilized.
   • Possible equipment failure and/or malfunction of my own or others’ equipment, which may have been rented, borrowed or personally owned.
   • My own negligence and/or the negligence of others, including employees, volunteers, agents, independent contractors or representatives of the Company.
   • Inadequate medical care or facilities in remote places.
   • Injuries and illnesses related to heat or cold weather such as dehydration, hypothermia, heatstroke, heat exhaustion and frosting among others.
   • Mental trauma, concussions, cuts and bruises, infections.
   • Theft
5. That my participation in the said outdoor adventure exposes my body and/or property to the inherent risks and hazards.
6. That such inherent risks and hazards may result in loss, injury, damage or even death.
7. That by virtue of my voluntary participation, I appreciate and assume the risks and hazards.
8. That during my participation, I am solely responsible for my own safety and/or that of my property beyond the bare minimum guaranteed by the company.
9. That to the extent allowed by law, I release, waive and commit not to sue the company, its management, officers, employees, agents, volunteers or partners, for any and all claims, damages, costs, attorney’s fees, or causes of action which I may have in the future, as a result of loss, injury, damage or even death arising out of or related to my participation in, or travel to and from the outdoor adventure hereby voluntarily subscribed to, provided that such injury, damage or death was unforeseen and/or unintended.
10. That as a precondition to participating in the outdoor adventure subscribed to, I have read and understood the contents of this ‘Voluntary Assumption of Risk and Release from Liability Form’ in its entirety and agree to its terms.
11. That it is my express intent that this Agreement shall bind members of my family and spouse (if any), my estate, heirs, administrators, assigns, and personal representatives.
